1. Introduction & Application

1.1 These Terms & Conditions (“Terms”) are a legally binding agreement between you (“you”/“customer”/“user”) and Old Town Flavours, a brand of Sri Matreya Products (hereinafter referred to as “we”/“us”/“our”).

1.2 Our registered/operational address: 10-27-16, Waltair Uplands, Siripuram, Visakhapatnam.

1.3 These Terms govern: 

(a) your access to and use of our website, mobile site, app, platform, or other digital channels; 

(b) your purchase, delivery, return, refund, or use of any products (including food & pre‑mix products) via our platform or authorised sellers/distributors.

1.4 By using the site or placing an order, you accept and agree to abide by these Terms. If you disagree with any part, do not use the site or place orders.

2. Registration & Accounts (Add this only if applicable)

2.1 If you must register an account, you guarantee that you are of legal age and have capacity to enter into these Terms.

2.2 You are responsible for (i) safeguarding your username/password; (ii) any activity done under your account; (iii) notifying us immediately of any breach or unauthorized use.

2.3 We reserve the right to suspend or terminate accounts that violate these Terms or for suspected fraud or misuse.

3. Product Information, Quality & Compliance – This is important

3.1 We warrant that all edible products sold comply with applicable food safety laws, particularly the Food Safety and Standards Act, 2006 and associated regulations. 

3.2 We commit to:

3.2.1 Listing nutritional information, ingredient list, allergen warnings, net weight, manufacturer/packer details, batch/lot number, expiry date, etc., on product packaging.

3.2.2 Clearly stating whether a product is vegetarian (green dot) or non‑vegetarian (brown dot) as required.

3.2.3 Ensuring label text is legible, in prescribed font sizes, in English/Hindi as per FSSAI requirements.

3.3 We guarantee that products delivered will (subject to proper storage and handling by you):

3.3.1Conform to promised specifications (taste, shelf life, quality)

3.3.2Be free from defects, contamination, spoilage, or adulteration

3.3.3 Be delivered within usable shelf life (not near expiry)

3.4We affirm that we hold or will maintain all required licenses, registrations, and approvals (e.g. FSSAI license).

3.5 We reserve the right to refuse or cancel an order for reasons including but not limited to: mispricing, regulatory constraint, product unavailability, or issues with supply, even after order confirmation.

4. Pricing, Payments & Transaction Terms

4.1 Prices are as quoted on our site at the time you place the order (unless there is a manifest error).

4.2. We accept payment via the methods listed at checkout (cards, UPI, wallets, etc.).

4.2.1 Payment is due immediately at the time of order. In case of payment failure, we will not be liable for any consequences. If we overcharge you (due to technical or clerical error), we will refund the excess amount.

5. Delivery, Title & Risk

5.1 We will deliver to your specified address, within the serviceability area and within the estimated delivery period mentioned. 

5.2 Risk in the goods passes to you upon delivery. Title (ownership) passes to you only after payment is fully cleared.

5.3 You must examine the package at the time of delivery and immediately report any visible damage or tampering.

6. Cancellation, Returns, Replacements & Refunds

6.1 Orders for perishable or ready‑to-cook / ready-to-eat food items cannot be cancelled once they are shipped. ( See if this is applicable) 

6.2 Cancellations may be requested before shipment with proper order ID. Non-perishable items may be returned if unused, unopened, undamaged, and notified within 24 hours of receipt with evidence. 

6.3 Defective, damaged, expired, or wrong items must be reported within 24 hours of delivery. 

6.4 Refunds will be processed within 6–8 business days of approval and via the same payment method. 

6.5 No refunds for incorrect or incomplete addresses provided by the customer. 

6.7 We shall not accept claims for delivery delays due to force majeure, minor variations in packaging, or customer’s change of preference. 

6.8 Our liability in such cases shall not exceed the actual price paid for the product.

7. Intellectual Property & Use Restrictions

7.1 All intellectual property rights in our website, branding, content, logos, images, etc. vest in us or our licensors. Unauthorized use may result in claims for damages and/or criminal liability.

8. Acceptable Use, Prohibited Activities

8.1 You must not use our website for illegal purposes, interfere with its operation, transmit malicious code, use bots, or impersonate others. We may suspend or terminate access if we suspect violation.

9. Links, Third‑Party Content & External Sites

Our site may contain links to third-party websites. We are not responsible for their content. You may link to our site only with prior written permission.

10. Privacy, Data & Communications

Your use of personal data is governed by our Privacy Policy. By providing your contact info, you consent to transactional communications.

11. Modifications, Interruptions & Updates

11.1 We may revise, update, suspend, or discontinue our website or services at any time. 
We shall not be liable if the site is unavailable. Revised Terms become effective when posted.

12. Disclaimers, Warranties & Limitation of Liability

Our services and products are provided “as is, as available” with no warranties except those expressly stated. We do not warrant that outcomes will meet your expectations. 
Our aggregate liability shall not exceed the total amount paid by you for the product(s)giving rise to the claim.

13. Indemnification

You shall indemnify and hold us harmless from claims, liabilities, damages, or expenses arising out of your breach of these Terms or misuse of products.

14. Governing Law, Dispute Resolution & Jurisdiction

These Terms are governed by Indian law. Disputes shall be resolved exclusively by courts in Hyderabad, Telangana, / Visakhapatnam, Andhra Pradesh, unless otherwise mutually agreed.

Parties shall attempt amicable resolution before litigation.

15. Severability, Waiver & Assignment

If any provision is invalid, the rest remain enforceable. No waiver shall be effective unless in writing. You may not assign these Terms without our consent; we may assign to affiliates or successors.
